Heard learned counsel for the petitioner, Sri Birendra Pratap Singh, learned Standing Counsel and Sri Ramesh Chandra Upadhyay, learned counsel for the respondent- Gaon Sabha.
The contention of learned counsel for the petitioner is that the respondent no.6 to 10 have illegally encroached the public land which is recorded as Banjar land situate at Araji No.46. In this regard, the petitioner has approached the District Magistrate, Aligarh by filing an application dated 04.12.2018. The petitioner's counsel further submitted that since last several months petitioner is approaching the concerned authority but no heed is paid.
Having heard the learned counsel for the parties and with the consent of learned counsel for the respective parties, the writ petition is disposed of by directing the District Magistrate to pass appropriate reasoned order, in accordance with law, and in case, if the respondent nos.6 to 10 have illegally encroached the public utility land as indicated hereinabove, the same should be removed immediately preferably within two months.
The writ petition is disposed of.
