Heard Sri Maneesh Kumar, learned counsel for the petitioner, Ms. Manju Thakur, learned A.G.A. and perused the impugned F.I.R. as well as material brought on record.
This petition has been filed by the petitioner with a prayer that suitable direction may be issued to the respondent no. 2 to submit the progress report/police dairies under section 172 (2) Cr.P.C. and consequential report under section 173 Cr.P.C., if any, before this Court in pursuance of F.I.R. dated 31.12.2015 registered as case crime no. 1195 of 2015 under section 420 I.P.C., police station Karwi Kotwali, Tehsil Karwi, district Chitrakoot and further seek explanation from respondent nos. 2 and 3 as to why no progress has yet been made in the investigation in the present case even after passing of more than two years and lastly direct the respondent no. 3 to conduct fair and impartial investigation in the aforesaid case.
Learned counsel for the petitioner submits that the petitioner is the informant of the case. He lodged the present F.I.R. on 31.12.2015 but till date the investigation has not been concluded, hence he has come up before this Court by filing the present petition.
Learned A.G.A. could not dispute the aforesaid fact as argued by learned counsel for the petitioner.
So far as prayer nos. 1 and 2 made in the present petition are concerned, we are not inclined to grant the same. The same are hereby refused.
So far as prayer no. 3 made in the present petition is concerned, we direct the Investigating Officer of the present case to conclude the investigation of the present case and submit a police report before the Magistrate concerned expeditiously preferably within a period of four months from the date of production of a certified copy of this order in accordance with law.
The S.P. Chitrakoot shall ensure the compliance of present order within the aforesaid period.
With the aforesaid order, the present petition stands disposed of.
