1. Heard learned counsel for petitioner and Mr. Bipin Bihari Pandey appearing for respondents.
2. It is the case of petitioner that he is posted as Mandi Supervisor and due to retire on 31.01.2020 i.e. his retirement is due in about one and half years. However, he has been transferred from Kosi Kalan, Mathura to Agra on 31.05.2018 by the order impugned. He has referred to the provisions of the transfer policy issued by the State Government with respect to the U.P. Government Servant and provision therein regarding the embargo on transfer of Group - C employees who are at the verge of retirement just within two years. A provision has been made to give them option to be posted at a place of their choice.
3. Learned counsel for respondents says that it is doubtful whether annual transfer policy published by the State Government shall be applicable to Krishi Utpadan Mandi Parishad Employees also. However, he does not dispute that the petitioner is due to retire on 31.01.2010.
4. Accordingly this writ petition is disposed off without entering into the merits of the controversy with a direction to the authority concerned to consider the representation made by the petitioner on 19.06.2018 and 17.07.2018 to the Respondent No.
2 and dispose off the same sympathetically looking into his grievance. A decision shall be taken by the Respondent No. 2 within a period of three weeks from the date a certified copy of this order is produced before him.
