Affidavit of compliance filed by learned AGA for the State is taken on record.
Heard Sri Amrit Raj Chaurasia, learned A.G.A. for the State and perused the record.
No one is present for the applicant.
Trial court vide its report dated 20.9.2019 submitted in compliance of the Court's order dated 6.9.2019 has prayed that some further time may be allowed to conclude the trial as the report of Vidhi Vigyan Prayogshala was received on 9.9.2019 and thereafter the case has been fixed for prosecution evidence. The statement of PW-7 has already been recorded on 17.9.2019.
Trial court is further directed to conclude the trial within a further period of six months.
In view of the above, I find no good ground for grant of bail to the applicant Pawan Gupta, involved in Case Crime No. 0105 of 2017 under Sections 323, 307, 147, 148, 427, 302 and 34 I.P.C., police station Khora, District Ghaziabad.
Accordingly, the bail application is rejected.
However, the trial court is directed to expedite the trial of the aforesaid case and conclude the same within preferably a period of six months from the date of production of a certified copy of this order, if, there is no legal impediment.
Registrar General of the Court is directed to send a copy of this order to the trial court concerned for necessary information and follow-up action.
