Heard learned counsel for the applicant, learned AGA and perused the record.
Learned counsel for the applicant submitted that showing two cases against the applicant in gang chart, the applicant was challanned under Gangster Act. One case was under N.D.P.S. Act in which the applicant was acquitted. However, in the present case the applicant is in jail since 1.12.2010.
In view of the above, without expressing opinion on merit, let the applicant Pawan alias Chintu Shive Hare be enlarged on bail on his furnishing a personal bond with two sureties each in the like amount to the satisfaction of the court concerned in Case Crime No. 362/2008 under Section 2/3 U.P. Gangster and Anti Social Activities Act, PS Attra,District Banda.
