Petitioner claims to have been appointed on the post of Assistant Clerk in Baba Haripuri Inter College, Kasawa, District Kannauj, which is an institution recognized under the provisions of the U.P. Intermediate Education Act, 1921 and upon which the U.P. Payment of Salary Act, 1971 are also applicable. It is asserted that vacancy was advertised in newspapers 'Buland Bharat' and 'Aman-Ke-Sipahi' and he was appointed in the year 2010. A communication of the Manager dated 5.3.2021 is assailed, as per which petitioner's appointment has not been approved, as such he cannot continue in service.
While entertaining the writ petition time was granted to learned Standing Counsel to obtain instructions. Instructions have been obtained from the District Inspector of Schools, Kannauj, as per which the Manager has informed the Inspector that no appointment in the year 2010 was actually made on the post of Junior Clerk and no such vacancy was ever advertised. It is also submitted that petitioner has not been appointed and the claim itself has been put forth on the basis of fabricated documents. Instructions in that regard are taken on record.
None otherwise appears for the petitioner even when the matter is taken up in the revised list.
Writ petition, accordingly, is dismissed for want of prosecution.
