JUDGMENT / ORDER

The petitioner has approached this Court seeking a direction to the respondent to issue permit and 'P-Form' for transporting the red earth removed from the top portion of the rocks for the purpose of extracting granite stones and kept in the premises of the quarry on the basis of Ext.P1 quarrying permit, without insisting for no objection certificate from District Collector or the State Environmental Impact Assessment Authority. 2. Apparently the petitioner has quarrying lease in terms of Ext.P1. He has to remove top soil for the purpose of extracting granite. In order to remove the said top soil, the respondents cannot insist on no objection certificate from the District Collector or the State Environmental Impact Assessment Authority. Hence, I am of the view that this writ petition can dispose as under:
The respondent shall consider Ext.P2 representation and pass appropriate orders without insisting for no objection W.P.(C) No.13248 OF 2014 2 certificate from the District Collector or the State Environmental Impact Assessment Authority. Orders may be passed within two weeks from date of receipt of a copy of this judgment.
