Heard learned counsel for the applicant and learned A.G.A. for the State.
The present petition under Section 482 Cr.P.C. has been filed for a direction to the 3rd Additional Chief Judicial Magistrate (J.D.) Ghaziabad to consider and decide the Case No. 610 of 2009 ( State Vs. D.P. Sharma and others), under Sections 420, 448, 504, 506 IPC, P.S. Indrapuram, District Ghaziabad as expeditiously as possible.
No useful purpose would be served in keeping the petition pending, which is finally disposed of with a direction to 3rd Additional Chief Judicial Magistrate (J.D.) Ghaziabad, to consider and decide the Case No. 610 of 2009 ( State Vs. D.P. Sharma and others), under Sections 420, 448, 504, 506 IPC, as expeditiously as possible, in accordance with law, after hearing the concerned parties, preferably within a period of one year from the date of production of certified copy of this order before the concerned court below, in case the proceedings of the aforesaid case is not stayed by any Court.
