Being aggrieved of Ext. P1 order imposing penalty upon the petitioner, he has already availed statutory remedy by way of Ext. P2 revision before the 3rd respondent. After considering Ext. P3 I.A. for stay, Ext. P4 order came to be passed, directing the petitioner to satisfy 30% of the disputed liability within two weeks, so as to avail the benefit of interim stay. The learned counsel for the petitioner submits that by virtue of unforeseen circumstances the condition could not be satisfied on time and hence the respondents are proceeding with the recovery proceedings, vide Ext. P7. Hence the writ petition.
2. The learned counsel for the petitioner submits that the petitioner is ready to satisfy the condition, if some breathing time is given in this regard.
3. Heard the learned Government Pleader as well.
4. Considering the limited extent of relief sought for, the petitioner is granted further period of two weeks from today to W.P.(C) No. 27103 of 2014 : 2 :
comply with the condition imposed by the appellate authority, vide Ext. P4 order. It is made clear that, if the petitioner fails to satisfy the requirement within the said period, it will be open for the respondents to proceed with recovery proceedings, pursuant to Ext. P7.
The Writ Petition is disposed of.
