(Per : HONOURABLE MR.JUSTICE V. M. SAHAI) We have heard Mr.S. N. Soparkar, learned standing senior counsel assisted by Mr. B. S. Soparkar, learned counsel for the appellant and Ms. Paurami Sheth, learned advocate for the respondents.
2.0 In this writ petition, the dispute is in regard to amount recovered by the respondents inspite of the order interim order granted by the Commissioner of Income Tax. However, since the learned counsel for the parties agree that the appeal itself is pending, interest of justice would be served if the Commissioner of Income Tax (Appeal) is directed to decide the appeal of the petitioner within a period of three months from the date of receipt of certified copy of this order.
3.0 With the aforesaid observation and direction, the writ petition is finally disposed of. Notice is discharged. No costs.
