Heard Sri Birendra Prasad Maurya, counsel for the petitioner and learned Standing counsel.
By this petition, the petitioner seeks a direction in the nature of mandamus commanding the respondent no.2 Consolidation Officer, Khajani, District Gorakhpur to decide the Case No. 53 of 2018 filed under Rule 109-A of U.P. Consolidation of Holdings Rules 1954 (in short 'Rules'), within a stipulated period of time.
Contention of the learned counsel for petitioner is that the petitioner filed an application under Rule 109-A of the Rules on 24.12.2018 for implementation of the order passed by the consolidation authorities in his favour, as on the basis of the same his name has not been recorded in the revenue record and the said application is pending since 2018.
In the facts and circumstances of the case, direction is issued upon respondent no.2 Consolidation Officer, Khajani, District Gorakhpur to decide the Case No. 53 of 2018 filed under Rule 109-A of U.P. Consolidation of Holdings Rules 1954 in accordance with law expeditiously, preferably within a period of four months from the date of production of a certified copy of this order.
With the above direction, the writ petition stands finally disposed of. No order as to costs.
