JUDGMENT / ORDER

The petitioner has approach this Court challenging Exts.P2 and P3 and seeking a direction to the 5th respondent to accept the land tax of the property having an extent of 4.48 Ares comprised in Survey No.385/1 and 385/32 of Ernakulam Village. According to the petitioner, the owner of the property is his father and on account of his death he is one of the legal heirs and owner of the property. Therefore he is entitled to pay tax in the name of all the legal heirs. One of the legal heirs passed away.
2. It is admitted by the learned counsel for the petitioner that there are four kudikidappukars and the Land Tribunal had declared their rights in respect of 600 square links each. But they have not so far produced any records relating to the rights declared by the Land Tribunal. In this regard the petitioner will have to approach the revenue authorities for demarcating their properties from the WP(C).No.16378/2014-V.
2 property recovered by kudikidappu rights of the persons in possession and thereafter alone he is entitled to pay tax in respect of the property.
3. In the said circumstances this writ petition is disposed of as under:
The petitioner and other legal heirs of the predecessor of late Sri.Mathew shall file necessary application before the revenue authorities for demarcating the properties allotted in favour of the kudikidappukars and thereafter the request made by the petitioner shall be considered by the authorities in accordance with law.
