Heard learned counsel for the petitioner; learned Standing Counsel for the respondent No. 1, Sri Narendra Kumar Giri, learned counsel for respondent Nos. 2 and 3 and perused the record.
By way of present petition, petitioner is challenging the recovery of Rs. 3,17,146/- and petitioner has also annexed a letter of Bank dated 24.4.2018 as Annexure-1 to the writ petition by which Bank has directed the petitioner to deposit an amount of Rs. 73,850/- under one time settlement scheme in single installment and thereafter his loan account shall be closed.
Sri Giri, learned counsel for respondent-Bank has also admitted that if petitioner is ready to deposit the amount of Rs. 73,850/- mentioned in letter dated 24.04.2018 written by the Branch Manager, U.P. Sahkari Gram Vikas Bank Limited, Branch Jaunpur, Bank will close will close his loan account and withdraw the recovery order as earlier issued.
Learned counsel for the petitioner stated that he is ready to deposit the amount of Rs. 73,850/- within a period of three weeks from today and in the light of statement given by the respondent-Bank, Bank will not proceed to recover the amount and the loan account of the petitioner shall be closed.
Considering the facts and circumstances of the case, the petition is disposed of with a direction to the petitioner to deposit the amount of Rs. 73,850/- within a period of three weeks from today.
It is made clear that if the petitioner has not deposited the amount of Rs. 73,850/-, it is open for the Bank to proceed with the recovery proceeding in accordance with law.
