COMMON ORDER:
These two writ petitions have been filed feeling aggrieved by the panchanama conducted against the petitioners in respect of their respective fair price shops.
As this Court found that the very initiation of action against the petitioners is contrary to law having regard to the fact that the alleged variations are well within the permissible limits, on 17.12.2014 this Court has directed personal presence of the Joint Collector, Anantapur. Accordingly, the Joint Collector appeared before the Court on 23.12.2014 and represented that as he has realised that initiation of proceedings under Section 6-A of the Essential Commodities Act, 1955 (for short ‘the Act’) is illegal, he has refrained from initiating any such proceedings. This Court has adjourned the cases to today in order to know what action is initiated against the Tahsildar concerned for sending report under Section 6-A of the Act.
Today, at the hearing, the learned Government Pleader placed before the Court the copies of the show-cause notices, dated 24.12.2014, issued by respondent No.2 to the Tahsildar, Beluguppa Mandal, Anantapur District calling for explanation as to why disciplinary proceedings shall not be initiated against him. As respondent No.2 has taken corrective steps in not only withdrawing the proceedings under Section 6-A of the Act, but also issuing show-cause notices to the Tahsildar, no further adjudication is necessary.
The writ petitions are accordingly closed.
As a sequel to disposal of the writ petitions, the pending interlocutory applications shall stand disposed of as infructuous.
