1. Heard learned Senior Counsel Shri Mukul Sinha for the petitioners, learned Counsel Shri Jigar Gadhvi for Respondent No.1 and learned APP, Shri H.L. Jani for Respondent No.2- State of Gujarat.
2. Learned Senior Counsel Shri Mukul Sinha has stated that in spite of the order passed earlier, a request for adjournment was not entertained. It is stated that the matter is kept for recording plea. Learned Counsel Shri Gadhvi stated that plea has been recorded.
3. In the above facts and circumstances, without any further comment, it is directed that the Additional Chief Judicial Magistrate, Kalol shall not proceed further with the Criminal Case No.653 of 2012 till the further orders, as it is noted that in spite of the order passed by High Court (Coram: Anant S.
SCR.A/769/2012 2/2 ORDER Dave, J.) dated 27.04.2012, and thereafter pending the matter before this Court, the plea is recorded. Therefore, this Court is constrained to pass this order regarding stay of further proceedings of Criminal Case No.653 of 2012 till further orders. The matter is adjourned to 17.09.2012. The Registrar General is directed to convey to the concerned Court.
