The grievance of the petitioner is that the execution court where the Execution Case No. 5 of 2012 is pending is lying vacant since long and because of vacancy in the Court, the matter is not being taken up. Accordingly, a direction has been sought upon the District Judge, Firozabad to transfer the Execution Case No. 5 of 2012 to some other competent court.
For such relief, the petitioner can move an application before the District Judge concerned under Section 24 of the Code of Civil Procedure.
In view of the above, this petition is disposed of by giving liberty to the petitioner to move such an application. If any such application is moved, the District Judge shall address the same in accordance with law.
