Patel vs Secretary

High Court Of Gujarat|25 June, 2012

JUDGMENT / ORDER

1.0 By way of present petitions, the petitioners have prayed for following relief/s:
[A].
Your Lordships may be pleased to issue a writ in nature of mandamus or any other appropriate writ/s. order/s. and/or direction/s directing the respondents to accept the applications of all the petitioners for the post of Multipurpose Health Worker ( Male), Class III fixing the maximum age limit of 26+15= 41 years for the candidate of general category and fixing maximum age limit of 26+145+5= 46 years for the candidate of SC, ST, SEBC and consider the applications of the petitioners accordingly pursuant to the Advertisement at Annexure A.
2.0 Looking to the prayer made in the petitions, the petitioners wanted this Court to direct the authority to fix particular age limit for a particular post, which is not the function of the Court. Varying or revoking, whether prospectively or retrospectively, the conditions of services is exclusively a legislative function and a Court is not empowered to issue a writ directing to fix a particular age for a particular post. The petitions are misconceived and are therefore dismissed. Notice is discharged with no order as to costs.
