(Per : HONOURABLE MR.JUSTICE C.L. SONI) This application is filed by the applicants for restoration of Civil Application No. 11576 of 2011 in First Appeal (Stamp Number) No. 3099 of 2011.
By order of this Court dated 10.11.2011, office objection was ordered to be removed on or before 24.11.2011 failing which, it was ordered that the matter will stand dismissed for non prosecution. As the office objection(s) were not removed on or before 24.11.2011, above said Civil Application stood dismissed for non prosecution and, therefore, applicants have filed this application for restoration of Civil Application No.11576 of 2011.
Learned Advocate for the applicants stated that the applicants would remove the office objection(s) within one week.
Therefore, considering the averments made in this application supported by affidavit and also considering the submissions made by learned advocate for the applicants, this application is allowed. Civil Application No. 11576 of 2011 in First Appeal (Stamp Number) No. 3099 of 2011 is restored on files. Consequently, order of this Court dated 10.11.2011 stands recalled. Applicants are given one week time to remove office objections, failing which the matter shall again stand automatically dismissed for non prosecution.
This Miscellaneous Civil Application stands disposed of accordingly.
