Patel vs Joint

High Court Of Gujarat|30 April, 2012

JUDGMENT / ORDER

This application has been filed with a prayer to permit the applicants (original petitioners) to delete opponents Nos.7/1/1, 7/1/2 and 7/1/3, from the petition.
Heard Mr.Tejas P.Satta, learned advocate for the applicants, Mr.Neeraj Soni, learned Assistant Government Pleader, for respondents Nos.1 and 2, and Mr.J.V.Vaghela, learned advocate for respondents Nos.3 to 6, and perused the averments made in the application.
It is submitted by Mr.Satta that the names of opponents Nos.7/1/1, 7/1/2 and 7/1/3 have been wrongly mentioned in the cause-title of the petition though they were deleted before the Gujarat Revenue Tribunal, as can be seen from the impugned order.
Mr.Neeraj Soni, learned Assistant Government Pleader, as also Mr.J.V.Vaghela, learned advocate for respondents Nos.3 to 6, have no objection if the prayers made in the application are granted.
Accordingly, the following order is passed:
As it appears from the record that opponents Nos.7/1/1, 7/1/2 and 7/1/3 have been wrongly impleaded in the petition, having been deleted in the proceedings before the Gujarat Revenue Tribunal, the applicants are permitted to delete the said opponents from the array of respondents in the petition. The necessary amendment in the cause-title of the petition be made within a period of one week from today.
The application is disposed of in the above terms.
