JUDGMENT / ORDER

1. Rule.
Mr.Shalin Mehta, learned advocate waives service of notice of Rule on behalf of Opponent Nos.1 to 4 and Ms.Krina Calla, learned Assistant Government Pleader waives service of notice of Rule on behalf of Opponent No.5.
2. With the consent of the learned advocates appearing on behalf of the respective parties, the present Civil Application is taken up for final hearing today.
3. Mr.Falgun Brahmbhatt, learned advocate appearing on behalf of the applicants does not press the present Civil Application qua vacating ad-interim relief granted by this Court with a liberty to file afresh application for the same relief, after respective applicants are permitted to be joined as party respondents in the main petition and it is requested to consider the prayer of the applicants to permit them to join as party respondents in the main Special Civil Application. Accordingly, the present Civil Application is dismissed as not pressed so far as prayer of the applicants to vacate ad-interim relief granted by this Court in the main petition with a liberty to file afresh application for the said relief.
4. Now, so far as prayer in terms of para 15(B) permitting the applicants to be joined as party respondents in the main petition is concerned, having heard learned advocate appearing on behalf of the applicants and considering the averments made in the present Civil Application and the application is not seriously opposed by learned advocate appearing on behalf of the respondents, prayer in terms of para 15(B) is hereby granted and the respective applicants are hereby permitted to be joined as party respondent Nos.4 to 7 in the main petition i.e. Special Civil Application No.10213 of 2008. Registry is hereby directed to amend the cause title of the main Special Civil Application accordingly. Rule is made absolute to the aforesaid extent. In the facts and circumstances of the case, there shall be no order as to costs.
