JUDGMENT / ORDER

1. On 26.03.2013 the following order came to be passed;
Learned advocate for the applicant is absent. Earlier, when the matter is called out, at that time, the learned advocate for the applicant was absent. Mr. F.B. Brahmbhatt, learned advocate for the respondent is present.
Learned advocate for the respondent submitted that he has personal difficulty and therefore, requests for time. Learned advocate for the respondent also directed to verify about the pendency of the cross-case filed against him by the applicant. The matter is adjourned.
2. Even today, learned advocate Mr. Barot has filed sick note. Prima facie, the application was filed after four years and cross-complaint has also been filed. In the interest of justice, the matter is adjourned. It is, however, clarified that interim relief granted is restricted up to the next date only and that if on next date, learned advocate Mr. Barot files sick / leave note, the interim relief shall automatically stand vacated.
