On 18th July, 2011, this matter had been adjourned on 1st August, 2011 as the learned advocate for the appellant had prayed for time to bring on record the heirs and legal representatives of deceased respondent No.1/1b. However, it appears that till date, no such application has been moved. The appeal has been listed for final hearing on the board of 9th January, 2012 and has been called out on each day till today. At all calls, the learned advocate for the appellant has not remained present. In the circumstances, the court is left with no option but to dismiss the appeal for want of prosecution.
