Mr.Pravin Panchal, learned advocate for Mr.Prakash K. Jani, learned advocate for the respondent has placed on record the copy of the letter dated 12.03.2009 addressed by Mr.Prakash K. Jani, learned advocate for the respondent to the Registrar of this Court stating that the appellant expired on 08.02.1999. By the said letter, it was also informed that even the respondent expired on 21.02.2000 as well as his power of attorney holder expired on 05.11.2007. The xerox copy of the death certificates of the appellant, respondent as well as power of attorney holder of the respondent are annexed with the said letter.
In view of the above, the present Second Appeal stands abated.
