By way of this petition, the petitioner has challenged the order of the Labour Court in Reference (LCK) No. 208 of 1986 passed on 30.4.2004 whereby the Labour Court granted compensation in lieu of reinstatement. 2. The petitioner was serving as clerk-cum-typist. He was relieved from service without complying the provisions of law. Therefore, he preferred Reference before the Labour Court.
3. The Labour Court after considering the facts on record, passed an order granting compensation of Rs. 40,000/-. However, no reinstatement order was passed.
4. Heard learned counsel for the parties. After considering the evidence of record, the Labour Court has come to the conclusion that ends of justice will meet if compensation of Rs. 40,000/- is awarded in lieu of reinstatement. I am in complete agreement with the decision of the Labour Court in awarding compensation in lieu of reinstatement. Even otherwise, subsequently, the petitioner has pursued the profession. In that view of the matter, the amount of compensation of Rs. 40,000/- will be paid to the petitioner within two months.
5. In the result, the petition is dismissed. Rule is discharged. No order as to costs.
