1. Heard Mr.P.S.Patel, learned counsel for the petitioner, Mr.D.M.Devnani, learned Assistant Government Pleader for respondent Nos.1 & 2, Mr.Manish Patel, learned counsel for respondent No.3 and Mr.H.S.Munshaw, learned counsel with Mr.Rajesh Chauhan, learned counsel for respondent No.4.

By way of this petition under Article 226 of the Constitution of India, the petitioner has predominantly prayed for appropriate writ, order or direction, directing the respondents to transfer the petitioner from Surendragar to Sabarkantha District on the contentions which are raised in the petition.
3. This Court (Coram:S.R.Brahmbhatt, J.) vide order dated 19.12.2012, notice for final disposal was issued. Though the affidavit is filed during the pendency of this petition, by office order dated 05.08.2013, the petitioner has been transferred from Sayla-4, Primary School, Tal: Sayla, Dist: Surendranagar to Suratanpura Primary School, Group Aniyor, Tal: Malpur, Dist: Sabarkantha. A photocopy of the aforesaid office order dated 05.08.2013 is tendered by learned counsel for the petitioner and the same is taken on record.
4. In view of the aforesaid development during the pendency of this petition, the petition as such becomes infructuous, as the petitioner has been transferred from Surendranagar. Therefore, learned counsel for the petitioner does not press this petition.
5. Accordingly, the petition stands disposed of as not pressed. Notice is discharged. No order as to costs.
