1. Heard Mr.B.N. Patel, learned counsel appearing for the petitioners and Ms.Asmita Patel, learned Assistant Government Pleader.

Mr.Patel, learend counsel appearing for the petitioners, points out that the issue involved in the present petition is covered by the judgment of this Court (Coram: Jayant Patel, J) in the case of Babubhai Vitthalbhai Patel through Power of Attorney Vs Mamlatdar and Agricultural Lands Tribunal (Ganot) and another decided on 17-18-23/01/2007.
3. In the affidavit-in-reply filed by the State Authorities, it is pointed out that the aforesaid judgment relied upon by Mr.Patel, learned counsel for the petitioners, is subject SCA/7051/2011 2/2 ORDER matter of Letters Patent Appeal filed by the State of Gujarat and the same is pending.
4. Hence, Rule, returnable on 26th November, 2012.
