(Per : HONOURABLE MR.JUSTICE V. M. SAHAI) 1. We have heard Mr. Dipak R. Dave, learned counsel appearing for the appellants – original petitioners.
2. This Letters Patent Appeal has been filed challenging the interim order dated 10.7.2012 passed by the learned Single Judge in Special Civil Application No.15650 of 2011 whereby the learned Single Judge has admitted the writ petition and has expedited.
3. In our opinion, no interference is called for in the impugned order of the learned Single Judge. It is always open for the appellants to move an application before the learned Single Judge requesting for fixing early date of hearing of the writ petition.
4. In the result, this Letters Patent Appeal fails and is accordingly dismissed.
In view of dismissal of appeal, Civil Application for stay does not survive and is accordingly dismissed.
