1.0 This petition is directed against the judgement and award dated 03.05.2003 passed by the Industrial Tribunal, Ahmedabad in Reference (I.T) No. 357 of 1997 whereby the Reference of the petitioner came to be rejected.
2.0 The petitioners are working as Drivers and Conductors in the Mehsana Division of respondent in a various depots. All the petitioners are appointed by the Corporation after following due process of recruitment as per policy of the Corporation in the year of 1981 and all the petitioners are selected employees. The Corporation has given temporary appointments to all the petitioners. As per the policy of the Settlement Item No. 20 after completion of 180 days service of selected employees, a benefit of time scale i.e. minimum pay scale of that category is required to be given by the Corporation. The said benefit is not given even after completion of 180 days service. The petitioners therefore, raised a dispute which culminated into the aforesaid reference and the learned Tribunal passed the judgement and award as stated hereinabove.
3.0 Heard the learned Advocates for the respective parties and perused the relevant documents on record. It is found that all the petitioners have been confirmed by the ST Corporation from 01.04.1988 vide letter dated 07.05.1988 which is at Annexure F to the petition. It is also stated that communication dated 11.06.2012 has been received by the petitioners. In that view of the matter, it would be open to the petitioners to make representation before the respondent authority for appropriate reliefs. If such representation is made, the same will be considered by the concerned authority sympathetically.
4.0 With the above, petition stands disposed of. Rule is discharged with no order as to costs.
