Heard learned counsel for the assessee and the learned standing counsel for the State. By the impugned order Section 5 application of the State has been allowed by the Tribunal. The reasons given for allowing the Section 5 application are not valid. I, therefore, remand the matter back to the Tribunal to decide the same on merit and in accordance with law.
