The petitioner is a proprietorship firm. It is engaged in the business of working and maintenance for the Jalkal Vibhag, Nagar Nigam, Kanpur.
The grievance of the petitioner is that the respondents have invited a tender in the month of July, 2018 for awarding of contract for carrying on certain works of the Jal Kal Vibhag, but the same has not been finalized. The petitioner claims that it is a successful bidder but without any justifiable reasons the respondents are not taking any final decision in pursuance of the said tender.
From the material on record it appears that for the redressal of its grievance the petitioner has made a representation dated 27th November, 2018 to the Secretary, Jal Kal Vibhag, Nagar Nigam, Kanpur, but the same has failed to elicit any response. A copy of the said representation is on the record as annexure-4 to the writ petition.
We have heard learned counsel for the petitioner, learned Standing Counsel and Sri Shri Ram Pandey, learned Advocate, who has accepted notice and put in appearance on behalf of the second respondent.
Having due regard to the facts of this case, we are of the view that the ends of justice require that the third respondent shall make an endeavour to address the grievance of the petitioner expeditiously, preferably within six weeks from the date of communication of this order.
Needless to say that this Court has not expressed its opinion on the merits of the case. The third respondent shall pass the order independently in accordance with law.
Accordingly, the writ petition is disposed of. No order as to costs.
