Rule.
The present Misc. Civil Application has been filed for restoration of the main matter, i.e. First Appeal (Stamp) No. 3007 of 2011 with Civil Application No.11550 of 2011 and recall of the earlier order passed by the Court (Coram:Anant S.Dave,J) dated 16.11.2011, by which the main matter was dismissed for non-prosecution.
Heard learned Advocate Ms. Jayshree Hingorani for the Applicants.
Having perused the grounds mentioned in the Application as well as considering the pragmatic approach, which is required to be adopted, the present Misc. Civil Application deserves to be allowed. The prayer in terms of paragraph 8(A) is granted. The order dated 16.11.2011 by which the main matter was dismissed for non-prosecution is hereby recalled and the First Appeal (Stamp) No. 3007 of 2011 with Civil Application No.11550 of 2011 is ordered to be restored to the file. Rule is made absolute.
The main matter shall be placed on board for admission hearing after the office objections are removed within a week.
