The above appeal pertained to the year 2008. From the proceedings recorded, it appears that the counsel appearing for the appellant was absent regularly. Though the matter was posted in the Lok Adalat also, the counsel failed to appear. By order dated 23.6.2014, this Court directed the Registry to show the name of the counsel appearing for the appellant in the cause list. When the matter was taken on 25.6.2014, there was no representation for the appellant and accordingly this Court directed the Registry to post the appeal for disposal on 1.7.2014. Today also, when the appeal is taken, neither the appellant nor his counsel present. The above approach of the appellant and his counsel shows that the appellant is Mat.Appeal No.788 of 2008 and Cross Objection No.18 of 2012 2 not interested in prosecuting this appeal. Accordingly, this appeal is dismissed for non prosecution. It is made clear that, as the appeal is not seen admitted, according to us, the Cross Objection filed in this appeal need not be considered.
