Notice returnable on 07.05.2012.
In the meantime and till the returnable date the order impugned shall remain stayed. However, it would be open to the respondent no.1 to approach the Court for vacation and/or modification of this order, even prior to the returnable date. It will be open to him to approach the Company for processing his connection, on payment, on the basis of Cost Contribution System without prejudice to the rights and contentions of the respondent no.1, so that he may not be left without supply pending adjudication.
This order is passed on account of the fact that Electricity Company is required to assess and charge under the Cost Contribution System on account of specific requirement qua the consumers and it could not have prima facie be considered to be matter falling under System Improvement Scheme.
