JUDGMENT / ORDER

1. Though served, nobody appears for the respondent. This application is filed for condoning the delay of 13 days caused in preferring the first appeal.
2. Having heard Mr. Hasurkar, learned Advocate for the petitioner and considering the averments made in the application and since it has not been controverted by filing any affidavit-in-reply, this application is allowed. Delay cause in preferring the first appeal is condoned. Rule is made absolute to the aforesaid extent.
