ADMIT.
The following substantial question of law arises for determination of the present Second Appeal.
(1).Whether in the facts and circumstances of the case, the learned Appellate Court was justified in reversing the findings given by the learned trial Court and consequently dismissing the suit ?
(2).Whether in the facts and circumstances of the case, the findings given by the learned Appellate Court is perverse and / or on misreading of evidence on record and consequently holding that plaintiff has failed to prove that there was a theft of electricity by defendant ?
(3).Whether in the facts and circumstances of the case when the defendant has not challenged the supplementary bill which was issued on ABCD formula before the learned Appellate Authority, was it open for the Appellate Court/ Civil Court to consider the legality and validity of the supplementary bill and / or the question whether the defendant has committed theft or not ?
