1. The present application under Section 5 of the Limitation Act has been preferred by the applicant-original plaintiff to condone the delay of 36 days in preferring the Second Appeal.

2. Though served, nobody appears on behalf of the respondent. Hence, there is no opposition to the present application.

3. Under the circumstances and even otherwise considering the averments made in the application as sufficient cause is shown, delay caused in preferring the Second Appeal is hereby condoned.

4. With this, the present application is allowed. Rule is made absolute accordingly. No cost.
