The petitioner is accused in Case Crime No. 46 of 2018 under Section 323, 325, 504, 506 I.P.C. at Police Station Robertsganj, Sonbhadra. Considering the imposition of Section 325 I.P.C., a medical report has been submitted.
The petitioner submits that a re-medical examination was also held, but no change in the medical report has been found and further the petitioner claims that before submitting the medical report the petitioner was not given any opportunity.
It is to be noted that for submission of medical report no opportunity is required. Medical report is a part of proceedings of criminal trial. In writ jurisdiction no interference is called for.
The writ petition is totally frivolous in nature. It is, accordingly, dismissed.
