In response to the order dated 06.05.2019, Shri K.R. Singh, learned Additional Chief Standing Counsel has placed the instruction dated 24.05.2019 sent by Additional District Magistrate (F&R), Ghazipur and submits that in response to the writ court order, the amount towards the compensation under Section 3H(3) of National Highways Act has already been quantified and as there are certain rival contenders, the matter is referred to the competent authority under Section 3H(4) of the National Highways Act.
In the facts and circumstances, once such categorical averment has been mentioned in the said instruction, then this Court is of the considered opinion that substantial compliance of writ court order has been ensured in the matter. However, it is always open to the applicant to press his claim before the appropriate forum.
With these observations, the contempt application is disposed of. Notice, if any, stands discharged.
