Heard counsel for the petitioner and learned Standing Counsel. The petition is being filed seeking following relief:
"Direct the Court below to decide the Revision No. 02623/2018, Compterized No. C-201814000002623 (Smt. Parwati Devi Vs. Prem Shankar Singh and others) along with Stay application within stipulated period in accordance with law"
The contention advanced by the counsel for the petitioner is that the proceedings wherefrom the revision arises are liable to be abated under Section 5 of U.P. Consolidation of Holdings Act as the village where the land in issue is situated is under consolidation operation consequent to notification under Section 4 of U.P. C.H Act issued in the year 2018.
Under the circumstances, this writ petition is disposed of directing the petitioner to file an application for abatement under Section 5 of the Limitation Act before the Board of Revenue annexing therewith the notification under Section 4 U.P. C.H. Act.
