Heard learned counsel for the petitioners and the learned Standing Counsel appearing for the State respondents and perused the record.
Present petition filed with a prayer to direct the respondents to return the deposited amount of Rs. 14,68,153/- along with interest.
Submission of learned counsel for the petitioners is that even though the appeal of the petitioner was allowed, however, amount deposited during appeal is not being refunded.
Learned Standing Counsel submits that it is not known as to whether revenue authorities have challenged the order of the appellate court. He however could not dispute that all such facts can be looked into by the Collector.
Accordingly, present petition stands disposed of with liberty to the petitioner to move fresh appropriate application before the respondent no. 2-District Magistrate, Sambhal who shall consider and decide the same, preferably within a period of two months from the date of filing of such application. In case the petitioner is found to be entitled for refund of the amount, appropriate orders shall also be passed.
It is made clear that this Court has not examined the merits of the claim of the petitioner.
No order as to costs.
