The petitioner has filed this petition under Articles 226 and 227 of the Constitution of India with a prayer to issue direction to respondent Nos.2 and 3 to register FIR upon written complaint given by the petitioner.
Upon issuance of notice, District Collector, Surat submitted a report to the Assistant Public Prosecutor / Government Pleader, High Court of Gujarat dated 15.02.2012, which reveals that proceedings of revenue and/or civil are undertaken by the parties and in the above circumstances, no direction, as payed for can be issued.
This petition is misconceived and is hereby rejected.
