1. The present application has been preferred by the applicant to condone the delay in preferring the Miscellaneous Civil Application (Stamp) No. 1365/2011 to restore Miscellaneous Civil Application No. 3056/2010 and to recall the order dated 03/12/2010 passed in the said Miscellaneous Civil Application No. 3056/2010.
2. Considering the fact that Miscellaneous Civil Application No. 3056/2010 came to be dismissed by this Court on merits by a detailed speaking order there is no question of granting any relief in the Miscellaneous Civil Application and/or restore Miscellaneous Civil Application No. 3056/2010. Hence, Miscellaneous Civil Application itself is misconceived and no relief can be granted in the said Miscellaneous Civil Application. Hence, the present application deserves to be dismissed and is accordingly dismissed.
3. In view of dismissal of the present application, no further order is required to be passed in Civil Application No. 39/2012, which also stands dismissed.
4. Consequently, Miscellaneous Civil Application (Stamp) No. 1365/2005 also stands dismissed.
