Learned advocate for the petitioner Shri M.H Pathak points out the order of this Court [Coram : M.R Shah, J.] dated 30th December 2009 rendered in Civil Revision Application No. 287 of 2009 whereby there is a specific direction in operation that there shall be stay of further implementation and operation of the judgment and decree dated 21/01/2008 passed by learned Principal Civil Judge [JD], Ahmedabad [Rural] in Regular Civil Suit No. 735 of 2003. He makes a statement at bar that on payment of the Court fees; as directed by the Court, Misc. Civil Application No. 55 of 2009 is restored back to the file and is still pending and yet in a clear violation of directions of this Court, Jangum warrant has been issued by the trial Court and the said order is impugned in the present writ petition.
