Court No. - 37
Case :- WRIT - A No. - 17233 of 2001 Petitioner :- Smt. Parvati Devi Respondent :- Union Of India & Others Counsel for Petitioner :- Surendra Nath Singh,Alok Singh Counsel for Respondent :- S.S.C.
Hon'ble Abhinava Upadhya,J.
Heard Sri Alok Singh, learned counsel for the petitioner and the learned Standing Counsel appearing for the State-respondents.
By means of this writ petition the petitioner has challenged the order dated 12th March, 2001 passed by the Personal Officer (C) for Commandant of the Ordinance Depot, Fort, Allahabad by which the claim of the petitioner for compassionate appointment by relaxation of rules has been rejected stating therein that in view of the limited number of vacancies and more deserving candidates in line, there is no justification for relaxation of rules. In the writ petition a stand has been taken by the petitioner that she is claiming appointment under the U.P.Recruitment of Dependents of Government Servants Dying-in-Harness Rules, 1974 (in short the Rules).
It is to be noted that these rules are not applicable to the service of the Union of India. The petitioner has prayed for relaxation of rules, which has been denied by giving sound reasoning.
That being the case, no relief can be granted to the petitioner at this stage.
The writ petition has no merit and it is, accordingly, dismissed.
