In view of the order passed earlier dated 16.02.2012, affidavit has been filed, which suggests that communication gap is resulted not delay.
Therefore, considering the guidelines laid down by the Hon'ble Apex Court in catena of judgment including the judgment of the Hon'ble Apex Court in case of State (NCT of Delhi) V/s Ahmed Jaan, reported in AIR 2009 SC (Supp.) 695., the present civil application deserves to be allowed.
The delay is condoned. The application stands disposed of as allowed. Rule is made absolute.
Civil Application for restoration is ordered to be placed for admission hearing on 5th March, 2012.
