JUDGMENT / ORDER

Hon'ble Vedpal,J.
Heard learned counsel for the petitioner and the learned Additional Government Advocate, who has accepted notices on behalf of opposite parties 1 to 3.
Under challenge in the instant writ petition is FIR relating to Case Crime No. 256 of 2010, under Sections 452, 323, 504 and 506 IPC, police station Gazipur, District Lucknow We have gone through the FIR and other documents annexed along with the petition.
It seems that a dispute with respect to marriage having been done by the petitioner with one Samar Vishwakarma has arisen between the parties i.e. opposite party no. 4 on the one hand as well as Samar Vishwakarma on the other hand and, therefore, there has been inimical terms between both the parties of filing various petitions before this Court. It is argued on behalf of the petitioner that the impugned FIR is offshoot of the same.
Accordingly, we direct for issuing notice to opposite party no. 4, returnable at an early date.
Let counter affidavit be filed by the respective opposite parties within six weeks. Rejoinder affidavit, if any, may be filed within next two weeks.
List this petition after expiry of the said period.
Till the next date of listing or till submission of charge-sheet, whichever is earlier, arrest of the petitioner in the aforesaid crime number shall remain stayed, provided she cooperates with the investigation, which shall go on.
