(PER : HONOURABLE THE CHIEF JUSTICE MR. BHASKAR BHATTACHARYA) Since Mr. Bhatt, the learned Assistant Government Pleader has appeared on behalf of the respondent Nos.1 and 2 and waives service of notice, formal notice need not be issued to these respondents.
We find that for effective adjudication of the dispute involved in the petition, presence of Akhil Gujarat Self Financed Nursing Colleges Management Association is necessary. We, accordingly, direct the petitioner to make Akhil Gujarat Self Financed Nursing Colleges Management Association as additional respondent and serve a copy of this application immediately, making the notice returnable on 26th September, 2013.
After hearing Mr. Dave, the learned Advocate appearing on behalf of the petitioner and Mr. Bhatt, the learned Assistant Government Pleader on behalf of the respondent Nos. 1 and 2, and after going through the materials on record, we find that the petitioner has made a strong prima-facie case to have interim order restraining the respondent No.2 from filling up ten seats in the management quota of the petitioner college till 26th September, 2013. We, accordingly, pass such interim order. Direct service today permitted.
Let the matter appear on 26th September, 2013 as fresh matter.
