O R D E R:
Heard learned counsel for the petitioner.
2. This writ petition was filed seeking a writ of Mandamus declaring the Proceedings No.C-II(8)/Engg. Re-admins/2010-11 dated 12.07.2010, issued by the first respondent University permitting re-admission of students into various courses during the academic year 2010-2011 after condoning break of studies during 2009-2010 as illegal. The petitioner was permitted to seek admission in the B.E. (Mechanical course) of II semester of second year during 2010-2011 in S.V.P. Engineering College, Visakhapatnam, after condoning the break of studies in 2009- 2010. The petitioner challenged the demand of admission fee of Rs.1,01,190/- in the middle of the academic year and the petitioner volunteered to pay Rs.41,000/- towards II Semester fee.
3. This Court, by order dated 31.12.2010, granted interim direction directing respondents 2 and 3 to permit the petitioner to attend classes on payment of Rs.41,000/- towards II Semester fee.
4. Though respondents 2 and 3 filed a vacate stay petition, none appeared for the vacate stay petitioners. But the learned counsel for the petitioner tried to contact her client, but there is no response. Obviously, the petitioner might have completed his studies during the interregnum.
5. In the circumstances, since the petitioner already paid an amount of Rs.41,000/- at the time of seeking admission in the second year course in II Semester, without deciding the merits of the case, this writ petition is closed giving liberty to the petitioner to approach this Court if cause of action survives for consideration. Pending miscellaneous petitions, if any, shall stand closed in consequence. No costs.
