1. Heard learned advocate Mr.Supehia appearing for the petitioner. He has relied on notification dated 21/07/1996 and also relied on the recommendations of DPC which was conveyed on 03/5/2010 and he submitted that in view of said notification/rules of July 1996 and also in light of the recommendations by DPC (made during the meeting dated 3/5/2010), the petitioner was entitled to promotion to the post of Gujarat Agriculture Services, Class-II from his post of Extension Officer (Agriculture) Grade-I and that therefore, the petitioner was, entitled for the higher pay scale since the petitioner was not promoted to said post of Gujarat Agriculture Services Class-II. However, without considering the said notification of July, 1996 and the recommendations by the DPC, the Competent Authority has passed the order dated 16/11/2010 which is contrary to the said rules/notification and the recommendations by DPC.
2. Having regard to the submissions made by learned advocate for the petitioner and the above mentioned notification and recommendations of DPC, below mentioned order is passed:
