We have heard learned A.G.A. for the State.
The appeal regarding appellant no.1, Parsu Ram Dubey, appellant no.2, Jhinak Dubey, and appellant no.4 Smt. Uma Devi, has already been dismissed as abated by this court vide order dated 10.9.2018.
We have perused the report of CJM, Gorakhpur dated 10.10.2018, which shows that the appellant no.3, Smt. Indu Dubey, has also expired two years back. The relevant documents in support of the said death have been annexed with the report of the C.J.M. concerned.
In view of the aforesaid the appeal on behalf of the appellant no.3, Smt. Indu Dubey also stands abated.
Accordingly, the appeal on behalf of all the appellants is being dismissed as having abated.
Let a copy of this order be certified to the court concerned for necessary consequential action.
As per office report dated 7.9.2018 lower court record has been received,the same be sent back to the court concerned for necessary consequential action.
